Trial Court 7-21-2011

The following actions were taken in Lake County trial court for the week ending Thursday, July 14, 2011:

• Joseph Edwin Robinson, 48, of Baldwin, pleaded no contest to a charge of disorderly person/obscene conduct. The defendant was sentenced to serve 90 days; 30 days now (three days CTS) concurrent with another case.

• Nicholas Lawrence Polacek, 27, of Branch, pleaded guilty to a charge of operating impaired. A charge of OWI was dismissed. The defendant was sentenced to pay fines and costs of $1,000, restitution of $55, and to serve 93 days at the discretion of the court within one year.

• John Patrick Barron, 57, of Byron Center, pleaded guilty to a charge of operating impaired. A charge of OWI was dismissed. The defendant was sentenced to pay fines and costs of $1,030 and to serve 93 days at the discretion of the court within one year.

• Michael Adam Manley, pleaded no contest to a charge of malicious destruction of personal property less than $200. The defendant was sentenced to pay fines and costs of $250 and to serve 93 days at the discretion of the court within one year.

• Matthew Robert Taylor, 22, of Grand Rapids, had a guilty plea to a charge of possession of a controlled substance (marijuana) deferred for a period of six months’ unsupervised probation. The defendant will pay a $350 oversight fee.

• Ritu Rani Choudhry, 20, of Ionia, had guilty pleas to charges of OWI and possession of a controlled substance (marijuana) deferred for a period of six months’ unsupervised probation. The defendant will pay a $350 oversight fee.

• Emmitt George Boxley, 46, of Idlewild, pleaded guilty to a charge of assault and battery. A charge of attempting to assault/resist or obstruct a police officer was dismissed. The defendant was sentenced to pay fines and costs of $250 and to serve 93 days; two days now (CTS) and the balance at the discretion of the court within one year.

• Gary Leeshawn Simmons, 39, of Baldwin, was arraigned on charges of forgery and embezzlement ($1,000 — $20,00) by and agent or trustee. Pretrial was scheduled for July 21 at 9 a.m. The defendant is free on $15,000 bond.

• Avin Lee Miles, Sr., 47, of Idlewild, pleaded not guilty to a charge of domestic violence. Pretrial was scheduled for July 21 at 1:30 p.m. The defendant is free on $5,000 bond.

• Steven Lee Cross, 43, of Irons, pleaded not guilty to a charge of assault and battery. Pretrial was scheduled for July 21 at 9 a.m. The defendant is free on personal recognizance bond.

• Joshua Howard Lodholtz, 25, of Chase, pleaded not guilty to a charge of domestic violence. Pretrial was scheduled for Aug. 4 at 11 a.m. The defendant is free on personal recognizance bond.

• Aaron Allen Thomas, 38, of Idlewild, pleaded not guilty to charges of OWI and possession of a firearm while under the influence. Pretrial was scheduled for July 21 at 9 a.m. The defendant is free on $3,500 bond.

• Jamie Scott Rees, pleaded not guilty to a charge of possession of a controlled substance (marijuana). Pretrial was scheduled for July 21 at 9 a.m. The defendant is free on $3,500 bond.

• Donald Nelson Clemens, 61, of Baldwin, pleaded not guilty to a charge of driving while license suspended/allowing a suspended person to operate (second or subsequent offense). Pretrial was scheduled for July 21 at 2 p.m. The defendant is free on $3,500 bond.

• Forrest James Dorman, 19, of Big Rapids, pleaded not guilty to a charge of possession of a controlled substance (marijuana). Pretrial was scheduled for July 21 at 9 a.m. The defendant is free on $3,500 bond.

• Ryan Patrick Tift, 18, of Big Rapids, pleaded not guilty to a charge of possession of a controlled substance (marijuana). Pretrial was scheduled for July 21 at 9 a.m. The defendant is free on $3,500 bond.

• Duston Wayne Holmes, 23, of Tustin, pleaded not guilty to a charge of operating an ORV while his license was suspended or revoked. Pretrial was scheduled for July 21 at 1:30 p.m. The defendant is free on $3,500 bond.

• Marvetta Diona Dockery, 39, of Idlewild, pleaded not guilty to a charge of third-degree retail fraud. Pretrial was scheduled for July 21 at 1:30 p.m. The defendant is free on $2,500 bond.

• Eric Von Henderson, 50, of Idlewild, pleaded not guilty to a charge of driving while his license was not valid or improper. Pretrial was scheduled for July 21 at 2 p.m. The defendant is free on $2,500 bond.

• David Louis Lee, Jr., 31, of Flint, pleaded guilty to charges of possession of a controlled substance (second offense) and resisting and obstructing a police officer. Charges of delivering or manufacturing a controlled substance (marijuana) and a second count of possession of a controlled substance (second offense) were dismissed. The defendant was sentenced to pay fines and costs of $798 and to serve 12 months; nine months now (126 days CTS) and the balance at the discretion of the court over a period of 24 months’ probation. He will pay a $480 probation fee; his license is suspended (restricted license after 60 days).

• Stephen Uel Metcalfe, 50, of Baldwin, pleaded not guilty to a charge of assault and battery. Pretrial was scheduled for July 21 at 9 a.m. Bond was set at $7,500. The defendant was currently lodged.

• James Leroy Tillison, 45, of Reed City, was arraigned on charges of OWI and of driving while license suspended/allowing a suspended person to operate (second or subsequent offense). Preliminary examination was scheduled for July 18 at 2 p.m. The defendant is free on $3,500 bond.

• Matthew Ryan Zierke, 24, of Terawa Terrace, NC, pleaded guilty to a charge of disorderly person/drunk and malicious destruction of personal property less than $200. For the first charge, the defendant was sentenced to serve 90 days; three days now (CTS) and the balance at the discretion of the court within one year. For the second charge, the defendant was sentenced to pay fines and costs of $250, restitution of $100, and to serve 90 days; three days now (CTS) and the balance at the discretion of the court within one year.

• David Alan Boroff, 48, of Baldwin, had a guilty plea to a charge of domestic violence deferred for a period of six months’ unsupervised probation. The defendant will pay a $350 oversight fee.

• Annette Marie Berg, 46, of Baldwin, pleaded not guilty to a charge of domestic violence. Pretrial was scheduled for July 21 at 1:30 p.m. Bond was set at $5,000. The defendant was currently lodged.

• Victor Todd Cronk, 46, of Baldwin, pleaded not guilty to a charge of domestic violence. Pretrial was scheduled for July 21 at 9 a.m. Bond was set at $5,000. The defendant was currently lodged.

• Shaundell Corvell Dukes, 29, of Baldwin, pleaded not guilty to a charge of domestic violence. Pretrial was scheduled for July 21 at 2 p.m. Bond was set at $3,500. The defendant was currently lodged.

• Stephanie Marie Chartrand, 24, of Harrison, was bound over to circuit court on a charge of possession of a controlled substance (methamphetamin/ecstasy). Bond was continued at $25,000. The defendant was currently lodged.

• Maureen Catherine Gilleran, 47, of Idlewild, was bound over to circuit court on charges of OWI and operating under the influence of liquor with an occupant less than 16 (second offense). Bond was continued at $5,000. The defendant was currently lodged.

• Tommy Silas Dunn, 53, of Gowen, was bound over to circuit court on charges of possession of a controlled substance (second or subsequent offense) and of having no valid operator’s license in his possession. The defendant is free on $2,500 bond.

• Valerie Annette Buck, 45, of Baldwin, was bound over to circuit court on a charge of three non-sufficient funds within ten days. The defendant is free on $10,000 bond.

• Nick Adam Clemens, 35, of Baldwin, pleaded guilty to a charge of parole violation. The defendant was sentenced to serve one year and four months to two years (136 days CTS).

• Tammy Kay Hanstine, of Three Rivers, pleaded guilty to a charge of careless operation of an ORV. A charge of operating an ORV under the influence of liquor was dismissed. The defendant was sentenced to pay fines and costs of $350.

• L.G. Roberts, of Lake, had a charge of recreational trespass dismissed.

• Phillip Lee Sprague, of Farwell, had charges of recreational trespass and of fishing in a closed stream dismissed.

• Henry Friedrich Brunnmeier, of Leslie, admitted responsibility to a charge of failing to deposit a camp fee. The defendant was sentenced to pay fines and costs of $80.

• Dawn Marie Alexander, of Pierson, had a default judgment issued on a charge of littering in a state forest. The defendant was sentenced to pay fines and costs of $160.

• Michael Alan Fekken, of Rothbury, had a default judgment issued on a charge of operating an ORV without a spark arrester. The defendant was sentenced to pay fines and costs of $95.

• Jerry Merle Eastman, of Stanton, pleaded no contest to a charge of careless operation of an ORV. The defendant was sentenced to pay fines and costs of $210.

• Samantha Lee Sauser, of Muskegon, admitted responsibility to a charge of the use of an ORV in a closed area of state land. The defendant was sentenced to pay fines and costs of $80.

• Bradley Allen Baker, of Grand Rapids, admitted responsibility to a charge of the use of an ORV in a closed area of state land. The defendant was sentenced to pay fines and costs of $80.

• Eric Brent Sandy, of Spring Lake, admitted responsibility to a charge of operating an ORV without a helmet or eye protection. The defendant was sentenced to pay fines and costs of $90.

• Keith Alois Kroening, of St. Joseph, admitted responsibility to a charge of personal flotation device violation (not enough). The defendant was sentenced to pay fines and costs of $75.
