TRIAL COURT: 6-2-2011

The following actions were taken in Lake County trial court for the week ending Thursday, May 26, 2011:

• Nicole Ray Garbacik, 23, of Alto, pleaded guilty to a charge of OWI.  Sentencing was scheduled for June 13 at 1:30 p.m.  The defendant is free on $5,000 bond.

• Dennis Lee Charles, 40, of Wellston, pleaded not guilty to a charge of OWI.  Pretrial was scheduled for June 2 at 2 p.m.  The defendant is free on $5,000 bond.

• Nathan Edward Koller, 21, of Rockford, pleaded not guilty to a charge of operating a motor vehicle without security and temporary registration plate violations.   Pretrial was scheduled for June 2 at 9 a.m.  The defendant is free on $5,000 bond.

• Shonneka Shontae Spencer, 27, of Muskegon Heights,  was arraigned on charges of possession of a controlled substance (marijuana), delivering or manufacturing a controlled substance less than 50 grams, and of having improper plates.    Pretrial was scheduled for June 2 at 9 a.m.  The defendant is free on $15,000 bond.

• Joseph Edwin Robinson, 48, of Baldwin, pleaded not guilty to charges of disorderly person/obscene conduct and second-degree retail fraud.  Pretrial was scheduled for June 2 at 2 p.m.  The defendant is free on personal recognizance bond.

• Stefanie Lynn Thompson, 18, of Allegan, pleaded guilty to a charge of larceny less than $200.  The defendant was sentenced to pay fines and costs of $250 and to serve 93 days; four days now (CTS) and the balance at the discretion of the court within one year.

• Adam Levi Smith, 26, of Baldwin, pleaded guilty to a charge of operating impaired.  A charge of OWI was dismissed.  The defendant was sentenced to pay fines and costs of $1,030 and to serve 93 days at the discretion of the court within one year.

• Kevin Michael Willis, 28, of Big Rapids, pleaded guilty to a charge of driving while license suspended/allowing a suspended person to operate.  A charge of  driving while license suspended/allowing a suspended person to operate (second or subsequent offense) was dismissed.  The defendant was sentenced to pay fines and costs of $250 and to serve 93 days; nine days now (CTS) and the balance at the discretion of the court within one year.

• Clyde Vernard West, 69, of Baldwin, pleaded guilty to a charge of operating impaired.  Charges of OWI, operating a motor vehicle without security, alcohol possession in a motor vehicle (passenger)  and of having  improper plates were dismissed.  The defendant was sentenced to pay fines and costs of $1,030 and to serve 93 days at the discretion of the court within one year.

• Shane Matthew Cooley, pleaded guilty to a charge of disturbing the peace.  A charge of driving while license suspended/allowing a suspended person to operate was dismissed.  The defendant was sentenced to pay fines and costs of $250 and to serve 90 days at the discretion of the court within one year.

• Phillip David Jennett, Jr., 42, of Baldwin, pleaded guilty to a charge of OWI.  The defendant was sentenced to pay fines and costs of $1,080 and to serve 93 days at the discretion of the court within one year.

• Nicholas Lawrence Polacek, 27, of Branch, pleaded not guilty to a charge of OWI/ impaired or in the presence of a controlled substance (second or subsequent offense).  Pretrial was scheduled for June 2 at 11 a.m.  The defendant is free on $10,000 bond.

• David Forrest Farrin, 52, of Ludington, pleaded not guilty to a charge of OWI/ impaired or in the presence of a controlled substance (second or subsequent offense).  Pretrial was scheduled for June 16 at 11 a.m.  The defendant is free on $7,500 bond.

• Carlton Deshawn Porter, 32, of Muskegon Heights, was bound over to circuit court on two counts of possession of a controlled substance (second or subsequent offense).  Bond was set at $15,000.  The defendant was currently lodged.

• Sharon Uluaina Albert, 58, of Chase, pleaded no contest to a charges of domestic violence.   The defendant was sentenced to pay fines and costs of $250 and to serve 93 days at the discretion of the court within one year.

• Rachel Ray Thocker, 34, of Eaton Rapids, was found guilty of a charge of parole violation.  The defendant was sentenced to pay fines and costs of $250 and to serve 90 days (68 days CTS).

• Kenneth Mark Medlin, 44, of Luther, was found guilty of charges of first-degree home invasion and of being an habitual offender (fourth offense).  The defendant was sentenced to pay fines and costs of $198 and to serve ten years to life.
